West Union Village Council met in regular session at 7 p.m., on Jan. 28, 2014, at the Municipal Building with Mayor Ted Grooms presiding. Call to order, pledge to the flag and roll call: John Lafferty - present, Mark Brewer - present, Benny McCarty - present, Jason Buda - present, Randy Brewer - present, Steve Rothwell - present; also in attendance: Tanya Johnson - Clerk, Shelley Gifford - Treasurer, Jerry Kirker - Village Administrator/Fire Chief, Roy Stricklett - Police Chief, Lisa Rothwell - Solicitor. Visitors: Officer Ken Reed, Steve Ogg - Tax Administrator, Tom Rolph, Terri Motil - EMS.


Motion by Benny McCarty to approve the Minutes of the regular meeting on Jan. 7, 2014 as distributed, second by Jason Buda, roll call vote: all yea, motion passed.


Motion by Steve Rothwell to approve payment of bills submitted second by Benny McCarty, roll call vote: all yea, motion passed.


Motion by Benny McCarty for a contract with Kenny Stephenson, custodian for 20 hours a week, at $8.50 per hour, second by Steve Rothwell, roll call vote: 5 yea, Mark Brewer - abstain, motion passed.


Motion by Benny McCarty for a contract with Patty Foote, part-time Police Department Clerk for 29 hours per week, at $9.00 per hour, second by Steve Rothwell, roll call vote: all yea, motion passed.


Motion by Mark Brewer for a contract with Debbie Vires, part-time Mayor’s Court Clerk for 20 hours per week, at $9.00 per hour, second by Benny McCarty, roll call vote: all yea, motion passed.


Motion by Steve Rothwell for a contract with Barbara Moore, Magistrate at $450.00 per court, second by Benny McCarty, roll call vote: all yea, motion passed.


Ordinance 2014-2 Policy and Procedures, motion by Mark Brewer for the second reading, second by Benny McCarty, roll call vote: all yea, motion passed.


Ordinance 2014-3 Approving, adopting and enacting American Legal Publishing’s Ohio Basic Code, 2014 Edition, motion by Steve Rothwell, second by Mark Brewer, roll call vote: all yea, motion passed; and declaring an emergency, motion by Benny McCarty, second by Mark Brewer, roll call vote: all yea, ordinance passed.


Resolution 2014-5 Resolution to Adams County Board of Election with the intention to proceed to levy tax in excess of ten mill limitation for the Police Department, motion by Mark Brewer, second by Benny McCarty, roll call vote: all yea, resolution passed.


Terri Motil, EMS spoke to Council on the contract between the Village and the Life Squad, the two new trucks and the amount of runs in 2013 and Jan. of 2014.


Report from Jerry Kirker, Village Administrator/Fire Chief

1. Discussion of the situation with the plowing of snow, break down of two snow plows, salt, grit and pot holes.
2. Discussion on water main breaks and frozen meters.
3. Discussion on problems with lift station in Watts Subdivision and Sparks Street.
4. The Back Flow Prevention Program is in place, letters will be sent out to residents that need to put them in place. Joey West has been trained and the Village has the equipment.
5. Problems with the new asphalt on Main Street, Kirker will work with ODOT on the matter.
6. Discussion on one of the police cruiser going to Camp Safety for repair.



Report from Roy Stricklett, Police Chief

1. The Police Department has received the two new laptop for cruisers, purchased by a grant, the Chief wants to purchase two stands for the cruiser to place the laptop on, Council agreed.
2. Discussion on the maintenance of the K-9 cruiser, motion by Steve Rothwell general maintenance or repair shall come out of General Fund - Police Department line item, major repair will come from K-9 unit Fund and/ or the Village Administrator desecration, second by Benny McCarty, roll call vote: all yea, motion passed.
3. Police Committee meeting will be held on Feb. 11, 2014 at 6 p.m. before the regular Council meeting.


Motion by Steve Rothwell for executive session for ORC 121.22 G1 appointment of employee, second by Benny McCarty, roll call vote: all yea. Motion by Rothwell to return to regular session, second by Benny McCarty, roll call vote: all yea.


Lisa Rothwell, Solicitor told the Council to review the Zone Ordinance, for more changes.


Council instructed the Clerk to set interviews with Russell Daniels and Robyn Ekstrand on Feb. 11, 2014 for the Tax Administrator’s position.


Mayor and Council thanked the Street Department and other employees that helped with the snow removal, great job.


The Village Administrator informed the Council that a raise will be going this month water/ sewer billings.


Discussion on Ordinance 2009-17 Keeping of Animals, the Mayor will be checking into the wording of this ordinance.


Discussion on the Minutes being placed in the newspaper and on the Village’s website, no action was taken.


The Mayor announced the Police and Mayor’s Court employees meeting went very positive and a lot was accomplished.


Motion by Jason Buda for executive session ORC 121.22 G1 compensation, second by Steve Rothwell, roll call vote: all yea. Motion by Jason Buda to return to regular session, second by Steve Rothwell, roll call vote: all yea.


Other items discussed were: warrant round-up, grants for the Police Department’s overtime, credit cards, door hanger to promote tax levy, employee’s raises, and electric bills.


Motion by Randy Brewer to adjourn, second by Benny McCarty, roll call vote: all yea, meeting adjourned.
